A Trump/DeSantis Ticket is Legally Workable

The midterm elections are only about two months away, but for many, it’s easy to look past them and start thinking about the 2024 presidential election.

On the Republican side, the two most talked-about candidates are former president Donald Trump and Florida governor Ron DeSantis. Many Republicans would like a ticket with Trump as the presidential nominee and DeSantis as the vice presidential nominee, to avoid a divisive primary that could cost them the presidency.

Some caution, however, that the 12th Amendment might prevent such a ticket, since it seems to suggest that two candidates from the same state cannot run on the presidential ticket. The language of the amendment reads: “[t]he Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves.”
